1. INTRODUCTION
The following general terms and conditions apply to all deliveries between us, GbR Terschüren, Erika & Römer, Katharina, ORIHIME DESIGNS, hereinafter referred to as ORIHIME DESIGNS, and the end customer; and regulate the use of our website and the purchase of goods via our online shop. Our online offer is aimed exclusively at end customers. An end customer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor self-employed. Your order will be executed by us based on our terms and conditions in the version valid at the time of the order. Our general terms and conditions apply exclusively to the entire business relationship. You should read them carefully before using our online shop. By using our online shop or placing an order through it, you agree to our general terms and conditions. If you do not agree to the terms, you will unfortunately not be able to use our online shop. The German language is the language of negotiations and contracts. For all transactions that are processed abroad, the following conditions also apply exclusively. Any natural person with unlimited legal capacity who concludes a legal transaction is entitled to register.

In order to make it easier for you to use our online shop, ORIHIME DESIGNS offers you the option of registering for a customer account. When ordering again, you do not have to re-enter all of your data, these are stored in the customer database of GbR Terschüren, Erika & Römer, Katharina ORIHIME DESIGNS and automatically inserted into the new order form. You can easily log in with your user name and password and do not have to enter all the information again. For your registration as a customer, ORIHIME DESIGNS requires the following information: Surname, first name, address and an e-mail address. Your e-mail address is automatically also your username. Then assign a password (at least 5 characters). If you have forgotten your password, you can go to "Login", "Forgot your password?". You will immediately receive the option to generate a new password in the email you specified. Your personal access data is only intended for you and must not be disclosed to third parties. As a customer, you are responsible for misuse of the access code and password. The information and personal data you provide to us will be processed taking into account and in accordance with the applicable data protection declaration. The data protection declaration of ORIHIME DESIGNS can be viewed in the online shop under data protection at any time.
By pressing the "Register" button in the ORIHIME DESIGNS online shop, this data is stored in the customer database of GbR Terschüren, Erika & Römer, Katharina ORIHIME DESIGNS. You thereby assure that all information you have provided is up-to-date, correct and complete. If we have reason to believe that false or fraudulent information or orders have been submitted, we reserve the right to cancel the orders, refuse registration, reverse immediately, terminate the customer account after a reasonable time, and if necessary, to inform the competent authorities. After your registration, we will automatically send you a confirmation email that your customer account has been set up for you. You have the option of deleting your customer account at any time. Please note our data protection declaration on the storage of data. Of course you also have the option to register as a guest.
4. CONCLUSION OF CONTRACT AND ORDER PROCESS
Our online shop website www.orihime-designs.com and the products offered there are merely an online catalog and not a legally binding contract offer on our part. They are a non-binding invitation to you to make offers to conclude a purchase contract for the to hand over the presented goods. By ordering the desired goods, you submit a binding offer.
The ordering process in our online shop comprises four steps:
You place the desired items in the virtual shopping cart.
You enter your customer data including billing address/delivery address.
You choose the payment method.
Now you have the opportunity to check all the information (ordered items, quantities, sizes, name, address, payment method) again and correct any input errors before you click the "Place Order" button to make your binding offer to buy the goods in your shopping cart deliver and send the item to us. After submitting your order, you will receive an e-mail from us with a summary of your order. This e-mail is an automatic acknowledgment of receipt of your order. Since it is an automatic e-mail, this does not yet represent acceptance of the offer. It is only used to document the receipt of your order. ORIHIME DESIGNS is entitled, but not obliged, to accept your contract offer within 14 calendar days after receipt of the offer by ORIHIME DESIGNS. If your offer is not accepted within 14 calendar days, it is considered rejected. The contract is only concluded when a written order confirmation is sent to you by e-mail or our shipping confirmation and at the latest when the goods are delivered. Our ordering system refers to all items offered in the ORIHIME DESIGNS online shop that are marked BESTELLUNG (also found in the product code). After you have received our order confirmation by e-mail and we have received your payment, we immediately start with the production process and then with the sewing process of your order. This type of order can take 15 to 30 business days. We will inform you regularly by e-mail if there are any delivery bottlenecks. In the case of custom-made products, we will, if necessary, contact you by e-mail in order to clarify any ambiguities. After you have received our order confirmation by e-mail and we have received your payment, we immediately start the production process and then the sewing process of your made-to-measure order. This type of order can take 15 to 30 business days. We will inform you regularly by e-mail if there are any delivery bottlenecks.
5. DELIVERY AND AVAILABILITY OF GOODS
We only deliver our goods within the Europe.
In our shop there are delivery restrictions regarding the countries to which we deliver, see point 7. Shipping costs.
ORIHIME DESIGNS delivers the goods in stock within 1-5 working days to your specified delivery address with the shipping company DHL GoGreen and/or Deutsche Post AG.
In the case of payment in advance, the period for delivery begins on the day after receipt of payment to the bank commissioned with the transfer and for all other payment methods on the day after the conclusion of the contract. If the end of the period falls on a Saturday, Sunday or public holiday at the place of delivery, the period ends on the next working day.
Products marked BESTELLUNG (also found in the product code) will be shipped after the sewing process is complete. You will be informed of this by email. After that, ORIHIME DESIGNS delivers the goods within 1-5 working days to your specified delivery address with the shipping company DHL GoGreen and/or Deutsche Post AG. The delivery period for all payment methods begins after the sewing process has been completed. If the end of the period falls on a Saturday, Sunday or public holiday at the place of delivery, the period ends on the next working day.
The risk of accidental loss and accidental deterioration of the item sold is only transferred to the buyer when the item is handed over to the buyer. When shipping available items and items marked BESTELLUNG within Europe, the delivery time increases to up to 14 working days, depending on the recipient location. If the delivery is affected by force majeure, the delivery time will be extended appropriately. We will inform you about this. As soon as the goods have been handed over to DHL GoGreen or Deutsche Post AG, you will receive a shipping notification that includes a link to track the shipment. With the tracking number, you can view the shipment status of your order at any time. If you order items that are temporarily or permanently unavailable in whole or in part, we will also inform you in a separate email. A contract for non-deliverable goods does not come about.
If the flawless product arrives damaged in transit, please contact us immediately so that we can assist you further.
You acknowledge that our printed matter and packages are carefully packaged and checked for perfect condition before dispatch: Improper handling on the transport route can damage the packaging and contents (buckled, dented, wet, opened, resealed). If you notice any visible damage upon receipt of the goods, have the freight forwarder/parcel service/courier confirm the damage in writing and inform us. You can easily claim the damage at any post office. In the event of a claim, please keep the packaging and the damaged goods until the matter is fully resolved. Photographic documentation is always an advantage. If the package is accepted WITHOUT a corresponding note, your claim in the event of damage will be lost!
6. PRIZES
The currency indicated is EURO (€). VAT is not shown (small business regulation, §19 UStG). Any postage and shipping costs are added according to the following list, see point 7. Shipping costs.
7. SHIPPING COSTS
The prices listed in the respective offers and the shipping costs are total prices and include all price components.
Within Germany:
We ship all orders within the Federal Republic of Germany for free.
Within Europe:
We charge a flat rate for shipping within the EU, EUR 10.00 per order.
ORIHIME DESIGNS will inform you of the shipping costs incurred in the order form. The goods are shipped via GbR Terschüren, Erika & Römer, Katharina ORIHIME DESIGNS.
8. TERMS OF PAYMENT
You can choose the payment option between: PayPal and Prepayment (bank transfer).
If you residence outside of Germany is the payment is exclusively by PayPal possible.

When paying with PayPal you will be forwarded directly to PayPal at the end of the ordering process. If you are already a PayPal customer, you can make the payment quickly and securely after logging into your PayPal account. If you do not already have a PayPal account, you can log in as a guest or open a PayPal account and then confirm the payment.

As soon as we can freely dispose of the amount, the payment is deemed to have been made.
Please note that voucher and discount codes cannot be applied or credited after an order has been completed. The value cannot be paid out. Voucher and discount codes can only be redeemed once. Voucher and discount codes are only valid for the specified period. Coupon and discount codes can be tied to specific products, campaigns or categories. Promotional coupon codes may have a minimum order value. This is always stated on the voucher or in the email with which you received the voucher and discount codes. In the event of a return, voucher and discount codes that can be redeemed once expire and will not be refunded. Voucher and discount codes CANNOT be combined with other voucher and discount codes.
9. RESERVATION OF TITLE
The delivered goods remain our property until the purchase price has been paid in full. You are obligated to inform us immediately in writing in the event of seizure of the goods or other interventions by a third party. The third party must be informed of the reservation of title of GbR Terschüren, Erika & Römer, Katharina ORIHIME DESIGNS.
10. COPYRIGHT
Our products, images, artwork, designs, logos and motifs that we sell or use are protected by copyright. Use, publication and duplication is only permitted with our express written consent.
11. RIGHT OF WITHDRAWAL
As a consumer, you have a statutory right of withdrawal. We would like to inform you below about the scope of the right of withdrawal.
Right of withdrawal
You have the right to revoke this contract within fourteen days without giving reasons.
The cancellation period is fourteen days from the day on which you or a third party named by you who is not the carrier took possession of the goods. If there is a contract for the delivery of goods in several partial shipments or pieces, on the day on which you or a third party named by you who is not the carrier took possession of the last partial shipment or the last piece.
To meet the cancellation deadline, it is sufficient for you to send the communication regarding your exercise of the right of withdrawal before the revocation period has expired. The costs of the return are always to be borne by you.

· Broken and untagged products: products must be returned unused and in their original packaging with clothing tags and other security devices or seals still attached and intact. We reserve the right to inspect the condition of any product that you wish to revoke and to make deductions where there is evidence that the product, its labels, security devices or seals have been used, removed, damaged or tampered with.
· Made to measure: The right of withdrawal does not apply to contracts - for the delivery of goods that are not prefabricated and for the production of which an individual selection or determination by the consumer is decisive or which are clearly tailored to the personal needs of the consumer. If the customer provides incorrect measurements, ORIHIME DESIGNS will not accept any costs, refunds or damages. GbR Schaschky, Erika & Römer, Katharina assume no liability for incorrect information.
· You take note that our carefully packed and printed products and packages be checked for perfect condition before dispatch: Improper handling during transport can damage the packaging and contents (kinked, dented, wet, opened, resealed). If you notice any visible damage upon receipt of the goods, have the freight forwarder/parcel service/courier confirm the damage in writing and inform us. You can easily claim the damage at any post office. In the event of a claim, please keep the packaging and the damaged goods until the matter is fully resolved. Photographic documentation is always an advantage. If the package is accepted WITHOUT a corresponding note, your claim in the event of damage will be lost!
- Furthermore, personalized products, such as printed matter or our Lucky Bags (Fukubukuro), are excluded from cancellation.
· In the event of a revocation of the contract and a return, the gift campaign item (scrunchies) must be sent back.
12. CONSEQUENCES OF WITHDRAWAL
If you revoke this contract, we must reimburse you for all payments that we have received from you, not including delivery costs, immediately and at the latest within fourteen days from the day on which we received the products of the revoked contract.
For this repayment, we use the same means of payment that you used in the original transaction, unless something else was expressly agreed with you.
We can refuse the repayment until we have received the goods back.
You must return or hand over the goods to us immediately and in any event no later than fourteen days from the day on which you inform us of the revocation of this contract. The deadline is met if you send back the goods before the period of fourteen days has expired.
You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

13. EXCHANGE
We do not offer exchanges.
If you want to exchange the product for a different size, color or another item, cancel the contract and simply order the product again in the online shop.
14. RETURNS
You bear the direct costs of returning the goods.

Please note that the right of return only applies to unworn, unwashed and flawless items. Products must be returned in a salable condition, which means they must be returned unused and in their original packaging with clothing tags and any other security devices or seals still attached and intact. We reserve the right to inspect the condition of any product you wish to return and to make deductions if there is evidence that the product, its labels, security devices or seals have been used, removed, damaged or tampered with.
Please return your return in perfect condition and within fourteen days.
Please pack your items in such a way that damage is avoided. We will charge you for any damage regardless of the reason. Damage is any type of modification to the product that differs from the perfect item from the factory.
In the event of a return, any redeemable voucher and discount codes will be forfeited. Gift voucher codes used will be refunded in this case. If you have any questions about this, please feel free to email us at support@orihime-designs.com.
15. GUARANTEE
You have the right to a guarantee for defects in the purchased goods in accordance with the statutory provisions. The warranty period for delivered goods is 12 months for entrepreneurs. Minor, technically unavoidable or customary deviations in quality, color, width, weight, shape, finish or design of samples do not constitute a defect. Minor color deviations of the products presented in the online shop are due to technical reasons. You are free to prove that the deviations mentioned are significant for you. All warranty claims expire if you have changed the goods or otherwise interfered with the goods or you can prove that you are not responsible for the intervention or the change for the defect.
16. CARE
Please follow the washing instructions on the labels of our items. If care instructions are not followed correctly, changes are made to the products and care products are used which we have advised against or which we have expressly declared to be unsuitable, the warranty is void. Please keep in mind that our products are all handmade. Please handle it gently and carefully.
17. NOTICE ON DATA PROCESSING
PROCESSING The protection of your personal data that you communicate to ORIHIME DESIGNS when using our online shop is very important to us. We transmit the data via an HTTPS connection, which is an additional layer of security used by the browser for data transmission from your site to the server.
This SSL encryption is used to ensure the confidentiality of communication. We strictly adhere to data protection. You agree to the storage, processing and use of the data transmitted by your order in accordance with the provisions of the Federal Data Protection Act for the processing of your order. Your order and address data will be used to process the order and also to transmit the data to the shipping partners involved (DHL GoGreen and Deutsche Post AG). The exact data protection regulations can be found under data protection.
18. LIABILITY
Claims for damages are excluded. Excluded from this are claims for damages from injury to life, limb, health or from the breach of essential contractual obligations as well as liability for other damages resulting from intentional or grossly negligent breach of duty by GbR Terschüren, Erika & Römer, Katharina ORIHIME DESIGNS, the legal representatives or vicarious agents.
19. DISCOUNT AND VOUCHER CODES
The following provisions apply to all ORIHIME DESIGNS discount and voucher codes. Discount and voucher codes are only valid for the period announced at the time of issue (extension is not possible). If the price of an order exceeds the credit of a discount code, the difference can be settled using the payment methods offered. GbR Terschüren, Erika & Römer, Katharina ORIHIME DESIGNS reserves the right to only accept one discount code per order. Discount and voucher codes CANNOT be combined. Discount and voucher codes are not paid out in cash or interest. Stolen or lost discount and voucher codes will not be refunded. GbR Terschüren, Erika & Römer, Katharina ORIHIME DESIGNS assumes no liability for stolen or lost discount and voucher codes. If GbR Terschüren, Erika & Römer, Katharina ORIHIME DESIGNS have a justified suspicion of misuse of discount and voucher codes, we reserve the right to refuse deliveries, reverse them immediately, block the customer account and, if necessary, the responsible to inform authorities. Transfer of discount codes is not permitted. Discount codes can be tied to a minimum order value. Especially in cases where the purchase value is below the value of the discount and voucher code, it is not possible to refund the remaining credit for administrative reasons. In some cases, discount codes are limited to individual products. In such cases, a transfer to other products is not possible. In the event of a return, discount and voucher codes that can be redeemed once expire.
20. GIFT CAMPAIGN
The following provisions apply to all ORIHIME DESIGNS gift campaigns. Gift campaigns are only valid for an announced period of time (extension not possible), or a fixed person limit. If the customer uses our ordering system and orders items with the label BESTELLUNG (also in the product code), after conclusion of a successful purchase contract, you will also be sent a gift campaign item (scrunchies) from our shop as a thank you.
Gift promotions will not be paid out in cash or refunded. Stolen or lost promotional gift items (scrunchies) will not be refunded. GbR Terschüren, Erika & Römer, Katharina ORIHIME DESIGNS assumes no liability for stolen or lost gift campaign items.
If GbR Terschüren, Erika & Römer, Katharina ORIHIME DESIGNS have a justified suspicion of misuse of gift campaign items, we reserve the right to refuse deliveries, reverse them immediately, block the customer account and, if necessary, the responsible to inform authorities. In the event of a cancellation of the contract or a return, the gift campaign item must be sent back.
21. DISPUTE RESOLUTION
Online dispute resolution in accordance with Art. 14 Para. 1 ODR-VO The European Commission provides a platform for online dispute resolution (OS), which you can find at https://ec.europa.eu/consumers/odr/. Note according to the Consumer Dispute Settlement Act We are fundamentally not willing and obliged to participate in dispute settlement proceedings before a consumer arbitration board.
22. FINAL CLAUSE
The contract and all changes to the contract must be in written form. The law of the Federal Republic of Germany applies, excluding the UN Sales Convention.
